A Message from Collaborative Attorney and Mediator Harold Brienes

The goals of Collaborative Divorce, Divorce Mediation and Marital Mediation are to redefine, not destroy the family. They strive to foster a cooperative spirit to problem solving that has among its goals an appreciation that money, while essential, is not the only medium of exchange. That preserving cherished relationships that have grown out of the marriage, finding peace of mind and moving confidently into one’s future life also have an honored place at the bargaining table.

By now, many people have heard of Collaborative Divorce and Divorce Mediation. But few have heard about Martial Mediation. Marital Mediation is for couples with serious problems, who still want to stay together. With their mediator's help, these couples first learn to separate their problems from themselves. Instead of pointing out each other's faults, they work together to identify, and then respectfully address the issues that are threatening their relationship. They attack the problem, not each other. The marital mediator guides them in searching for common ground. They are then able to address what each of them needs to allow the relationship to heal. I call my website "Humane Divorce" because in more than 26-years as a family lawyer, I have never had any clients who didn't yearn for a compassionate way to end their marriage.

Yes, everyone wants the best lawyer in town. But more and more people are finding that the path to a respectful divorce requires more than legal know-how.  It requires an attorney with a deep knowledge and understanding of the pain that is never far away.

Why then is humane divorce so rare? Why do so many divorcing couples - and their children - continue to suffer the anguish of divorce for years afterward?

The answer is that "going to court" or litigation in family law cases makes you and your spouse mere bit players in the most important drama of your lives. It gives the ownership of your divorce to your lawyers, and often discourages the two of you from finding a humane resolution based on your needs and interests.

Mediation and Collaborative Divorce put you and your spouse back in charge of your lives. Your trained collaborative lawyers or your impartial mediator help both of you identify your true needs and interests, and guide you to a truly humane parting of ways.
