GOING TO COURT WON’T SOLVE YOUR FAMILY PROBLEMS

By Harold Brienes, Collaborative Attorney & Mediator

After many years of "going to court" with divorcing couples, it became clear to me that families who litigate are more often in worse shape after the court battle is over than they were before it began. That’s because litigation pits the couple against themselves, attacking each other, instead of uniting them in attacking their problems. It does that by taking ownership of the divorce or the family problem away from the people involved and giving it to their lawyers to solve. Then, each litigating lawyer tries to get as much of the family resources as possible for his own client by taking them away from the other lawyer’s client. And, when that doesn't work, there's always the humiliating circus of going to trial. That's family warfare and it reduces both of you to mere bit players in the most important drama of your lives. And if your lawyers - who now own your divorce - can’t decide what’s best for you, a stranger in a black robe will make those decisions and you will have to live with them for a long, long time.

MEDIATION AND COLLABORATIVE ARE ALTERNATIVES

THOUSANDS OF PEOPLE HAVE CHOSEN

Here's Why:

  • Only you and your spouse or domestic partner have the right to set the goals that will determine your future.
    •

  • Your job is to identify those goals and the interests and needs that underlie them.

  • My job as your impartial mediator or collaborative lawyer is to help both of you realize those goals.

  • Together, we will brainstorm different options based on your interests and needs, in order to find the ones that will fit you best and bring you both closer to the best possible outcome for each of you, and your children.
    •
